ACCELEYE INCORPORATED PRIVACY POLICY – EFFECTIVE May 1st, 2024

This privacy policy applies to all users. The privacy policy describes the privacy practice of AccelEye, website and software. We take the privacy of our users very seriously; therefore, we only collect the information necessary to provide our services efficiently


1. Users using our website to trial our AI based web services, application and components:

We use your personal information to enable you to register with AccelEye and to provide you with our websites and apps, and services that you request. To just become a member, the only personal information we require is your email address and a username that you select. The username that you select is used as an onscreen name to identify you; it is strongly recommended that it is not be your real name, but a pseudonym. You will also select a password, which is needed to log on. We may also ask about your general geographic location, your occupation, and interests, but none of this information is required to register to the website.

2. Customers purchasing a service:

We collect certain information from a customer who is purchasing a service using our online ordering system. Such information may include: your name, your shipping address, your billing address, your credit card information, your email address, and your phone number. This information is used to process your purchase and to contact you if there is an issue with your purchase. We will share this information with our credit card payment processor. We will not store your credit card information on any of our server but credit card payment processor company store all of this information for the purpose of recurring payments, refunds, and/or charge backs. We will not use this information for any purpose other than to process your purchase, and will not share this information with any other third party, except as described above or as may be required by law. We may use your email address for marketing purposes, but only if you give your permission to do so during the purchasing process, and such permission may be withdrawn at any time by contacting us (via the methods listed under “Contact Information” below).

3. Security:

We implement commercially reasonable security methods to protect the information we collect from you. While the security of your personal information is of the utmost importance to us, we cannot absolutely guarantee the security of any information you choose to disclose.

4. Cookies:

We may use cookies and other technologies to track the use of our websites and apps. We will not use cookies to target advertisements to specific users. We may also allow cookies to be placed on your computer by third parties for the purpose of website analytics. This allows the third parties to collect data about your use of our website. The data collected by these cookies may include information such as your IP address or mobile identifier, the type of computer operating system, the web browser, the frequency with which the user visits various parts of our sites or applications, and information regarding the online or mobile service provider. Important Notice: This extension is designed exclusively for educational institutions and their managed Chromebooks. It is not intended for consumer, parental, or personal use.

 

1. AccelEye Systems’ Commitment to Your Privacy

Your privacy is critically important to AccelEye Systems. We have developed this Privacy Policy to outline how we collect, use, disclose, transfer, and store your information. AccelEye Systems is fully committed to the security and protection of your privacy.

AccelEye Systems provides educational insight services (“Services”) to help schools maintain safe digital learning environments. Our Services include educational technology management, content analysis, safety insights, and reporting tools. We understand the importance of privacy to our educational institution customers (“Schools”) and to students and staff (“End Users”) whose information we may access on behalf of a School.

Our Commitment:

  • We will always be transparent in the data we collect and how it is used
  • We will practice data minimization and only collect the data that is necessary for the educational safety insights that the school has purchased/contracted
  • We will always treat that data with the utmost security and privacy
  • We will never sell student personal information; we will never share it without the software license holder’s written authorization, and we will never use it to attempt to sell advertising to students

2. Applicability of This Privacy Policy

This privacy policy applies to our Services and describes the steps we take to protect your data. It details the terms surrounding our use of the personally identifiable information we collect, and our information gathering, use, maintenance, and dissemination practices necessary for the Services.

Please note that each School controls its instance of the Services and any associated data processed within that instance (“School Data”). If you have any questions about a School’s privacy practices, please contact the applicable School. For more information about who is the controller of data and under what circumstances, refer to the “Your Rights Regarding Your Data” section below.

3. Your Data: How We Collect and Use Information

Information About School Personnel

Schools decide which data is integrated with our Services. When a School administrator registers a School with AccelEye Systems or corresponds with us online, we ask for certain information including a contact name, school name, school district, school email address, school physical address and/or account name, phone number, job title, message content, and information relating to the School’s information systems. We may also retain information provided by a School if the School sends us a message, posts content to our website or through our Services, or responds to emails or surveys. Once a School begins using Services provided by AccelEye Systems, we will keep records of activities related to the Services. We use this information to operate, maintain, and provide the features and functionality of the Services, including customer service, support, and billing; to analyze our offerings and functionality; to communicate with our Schools and website visitors; to exchange information, and to offer related services.

Student Data

AccelEye Systems may have access to personally identifiable information about students (“Student Data”) in the course of providing Services to a School, including student name, email address, device information/identifiers, educational platform content, and usage data. We recognize Student Data is confidential and do not use such data for any purpose other than to provide the Services on the School’s behalf. AccelEye Systems receives Student Data only from the School and never interacts with the Student directly. The School confirms that it has obtained appropriate parental consent, as needed before the student is permitted to access the Services. AccelEye Systems has access to Student Data only as requested by the School and only for the purposes of performing Services on the School’s behalf.

Educational Content Analysis

In the course of providing educational insight services, AccelEye Systems may analyze content from educational platforms (Google Classroom, Gmail, Google Docs, etc.), communication tools, and other school-approved digital resources. This analysis is conducted exclusively for student safety purposes and educational insight reporting authorized by the School.

Device and Usage Information

We may collect certain device and usage information from school-managed devices, such as the date and time of access, the type of browser used, the type of operating system used, device identifiers, and aggregate information regarding what educational resources students access. We may collect data for Schools to generate reports of their users’ online activities within educational contexts.

4. Student Safety

COPPA and Children Under 13

AccelEye Systems complies with the Children’s Online Privacy Protection Act (COPPA). Students are not allowed to sign up for any AccelEye Systems solutions. Student accounts are provided only through a verified educator, school, or educational organization. Schools agree to obtain and maintain all necessary rights and consents, including consents required by COPPA, either from an End User or, where necessary, the End User’s parent or legal guardian, to allow AccelEye Systems to provide and improve the Services.

FERPA Compliance

AccelEye Systems operates under the “school official” exception in FERPA with legitimate educational interests for student safety insights and educational environment protection.

5. Third Parties: How We May Share Your Data

We may share personal information with:

  • Affiliates: Businesses or third parties AccelEye Systems is affiliated with in order to facilitate a transaction or service that the School has initiated or requested
  • Third Parties Supporting Our Offerings: Agents and service providers (sub-processors) that act on our behalf to support our services, such as technology services (e.g., web hosting and analytics services), subject to confidentiality obligations set out in the executed contracts with the service providers
  • Authorized School Personnel: Such as parents, teachers, administrators, or other School personnel at the direction of the School or to facilitate the service that the School has initiated or requested
  • Your Consent: Or the consent of (or at the direction of) a parent, guardian, or eligible student
  • Legal Requirements: Such as law enforcement or other officials when required by law or when we believe in good faith that it is necessary to comply with any legal, law enforcement, or regulatory process

We do not use personal information for any other commercial purpose.

6. California Privacy Rights

Privacy Information for California Residents – CCPA & CPRA

California Consumer Privacy Act (CCPA)

California law requires us to provide some additional information regarding your rights with respect to your “personal information” (as defined in the California Consumer Privacy Act (CCPA)). Unless certain exceptions apply, the CCPA allows you to request us to:

  • Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties with whom we share/disclose personal information
  • Provide access to and/or a copy of certain personal information we hold about you
  • Delete certain personal information we have about you
  • Provide you with information about certain financial incentives that we offer to you, if any

You also have certain rights under the CCPA not to be subject to certain negative consequences for exercising CCPA rights.

California Privacy Rights Act (CPRA)

The California Privacy Rights Act (CPRA) provides additional privacy protections for California residents, including:

  • Right to Access Information: Expanded right to access personal information regardless of when it was collected
  • Right to Opt-Out of Sharing Information: The right to opt out of both the sale and sharing of personal information to third parties
  • Right to Correction: The right to correct inaccurate personal information
  • Right to Limit Use of Sensitive Personal Information: The right to limit the use and disclosure of sensitive personal information

How to Exercise Your California Privacy Rights

California residents may make a request pursuant to their rights under the CCPA/CPRA by contacting us at support@acceleye.com. We will confirm receipt of your verifiable request within 10 days and provide information about how we will process your request.

We will respond to your request within 45 days of its receipt. Should we need more time, we will explain the reasons why and how much more time we need. Should we deny your request, we will explain the reasons behind our denial.

We do not charge a fee to process or respond to your verifiable request unless such request is manifestly unfounded or excessive.

Collection and Disclosure of Californians’ Personal Information

During the 12 months leading up to the effective date of this Privacy Policy, we have collected the following categories of personal information:

We do not “sell” or “share” California residents’ personal information as those terms are defined under the CCPA/CPRA.

California “Shine the Light” Disclosure

The California “Shine the Light” law gives residents of California the right under certain circumstances to opt out of the sharing of certain categories of personal information with third parties for their direct marketing purposes. We do not share your personal information with third parties for their own direct marketing purposes.

7. Your Rights Regarding Your Data

For Data That We Collect Via Our Products

Adult End Users of Services provided by AccelEye Systems should contact their educational institution or other organization providing the Services about their right to access their data collected and used by AccelEye Systems and requests related to their data. Schools may access and update account information and modify Services by signing into an administrator account.

Student Data

Student End Users of Services provided by AccelEye Systems and their parents should contact their educational institution or other organization providing the Services about access to the personal information collected by that institution.

8. Security: How We Store and Protect Your Information

Storage: All of your personal information is stored on servers at locations designed specifically to ensure that only authorized individuals have access to the server or its data. AccelEye Systems maintains strict administrative, technical, and physical procedures to protect information stored on our servers.

Practices: We have in place and maintain procedures and practices to ensure data security, including Security Policy, Incident Response Plan, Privacy/Security by Design, Vendor Assessments, and regular Privacy and Security Training.

9. Data Retention: How Long We Retain Your Information

We retain data for as long as necessary to fulfill the purposes for which it was collected. Following termination or deactivation of a School account, AccelEye Systems may retain profile information and content for a commercially reasonable time for backup, archival, or audit purposes, but all Student Data associated with the School will be deleted in accordance with AccelEye Systems Data Deletion policy.

10. Legal Basis for Processing Information

We rely on several legal bases to process data:

  • Consent to process data in any enquiry you submit to us to supply relevant, requested services to you
  • Legitimate interest for the proper administration and monitoring of our products and website
  • To fulfill a contract with our customers to provide them with the services they have subscribed to

11. Changes to Our Privacy Policy

We may update this Privacy Policy periodically to account for changes in our collection and/or processing of personal data, and will post the updated Privacy Policy on our website, with a “Last Modified” date at the bottom of the page.
